A technical problem: Right to compensation

After a long preparation of your trip for your holiday, or your business trip, here is a technical problem! and hop … you are facing a flight delay or cancellation!

Fortunately, you are protected by European regulations and you can even claim compensation if all the conditions are met.

Rights of air passengers in case of technical problem of the aircraft

If you are told that a technical problem is affecting the aircraft you were to take, and that this is the reason for the disruption, it should be noted that this cause is not one of the extraordinary circumstances mentioned in the European regulation ( EC) 261/2004, cases that exempt airlines from their compensation obligations.

According to the same regulations, the airline must provide assistance, including refreshments, meals, two communications, and accommodation if you have to spend the night in addition to transportation between it and the airport. This is possible if the delay of your flight exceeds:

  • 2 hours for flights of 1500 km or less.
  • 3 hours for late arrivals for intra-Community flights between 1,500 and 3,500
  • 4 hours late for other flights over 3 500 km within the European Union.
  • The 5 hours, you can get your plane ticket refunded if you wish (which must be done in 7 days).

Even in extraordinary circumstances (extreme weather, safety aboard the aircraft, political situation in a country), the carrier must obligatorily take care of the passengers.

A technical problem? You are entitled to compensation of up to € 600

It is quite normal that there are technical problems that arise in the airplanes of an airline, and it must absolutely maintain them and ensure the prevention of any problems related to the safety of its flights. These tasks are part of the normal business that airlines must handle, so technical problems are part of their responsibility, and are not considered extraordinary circumstances, as they presume!

You are entitled, in accordance with the European Regulation, to compensation, depending on the route of the flight:

  • € 250 for flights up to 1500 km.
  • € 400 for all intra-Community flights over 1500 km, and between 1500 and 3500 km for extra-community flights.
  • € 600 for the rest of the other flights.

The compensation will be paid by the airline, by the means that suits him (check, bank transfer, cash, … ect) it can also offer you benefits such as a voucher, which must be done with your agreement and that must be written.

Companies specialized in indemnifications

The mission of being compensated, and especially to verify your eligibility to claim it does not prove to be an easy task, especially if the airline opts for the excuse of “technical problem”.

There is a solution that could save you time and money. Indeed, you have many advantages with a company specializing in compensation, which will verify if you are really eligible for compensation and then proceed with the steps with your airline, to assert your rights, and even seize justice if the situation demands it.

The transaction is no initial fee, no financial risk for you. Compensation will be a percentage deducted from your compensation if successful, so no success-no fees charged.
